Eligibility
The contest is open to all residents of South East Asia and Hong Kong.
Each entrant may submit more than one video or photo in the competition.
For submissions to be considered, they must adhere to the guidelines laid out on this microsite. Please read all the information carefully.
All submissions must be received by Animax by 11.59pm (Singapore time) on 1 November 2009.
Submission GuidelinesEntrants must submit their video or photo on how much they love anime with the following technical specifications:Digital photographs
High quality video filmed on videocam, digicam or mobile phone
3GP, AVI or MPEG format
Duration of video to be minimum 1 minute and maximum 5 minutes
The contest begins on 14 August 2009 at 3pm Singapore time and ends on 1 November 2009 at 11.59pm Singapore time. Each entry must be received no later than the deadline of 11:59 PM on 1 November 2009 in order to be eligible for the Grand Prize.
PRIZES: Animax will select the best entries from all the eligible entries submitted. The best entry will receive one set of Bang & Olufsen earphones and one Nokia 1GB thumb drive. The next two bestentries will receive one set of Bang & Olufsen earphones each and the subsequent two best entries will receive one Nokia 1GB thumb drive each. A selected number of entries will be aired on the Animax channel and streamed on www.animax-asia.com (number to be aired is at the sole discretion of Animax).
ELIGIBILITY AND CONDITIONS:1.
Participants must be citizens or legal residents of countries in South East Asia and Hong Kong, where the Animax channel is available. “South East Asia” means collectively the following countries: Bangladesh, Brunei, Cambodia, Macau, Maldives, Malaysia, the Philippines, Singapore and Thailand.
2.
Participants can be of any age. Participants below 18 years old must seek consent from their parent or legal guardian (“Guardian”) prior to participating in the contest and each Guardian who provides such consent must, in addition, warrant and undertake that they are the legal guardian of the participant, that they will comply with these Official Contest Rules, and that they will ensure that the participant complies with and performs the participant’s obligations under these Official Contest Rules. Each Guardian agrees to provide such warranty and undertaking in writing where requested by Animax.
3.
Employees, agents, branches and promoters (including their immediate family members) of SPE Networks – Asia Pte. Ltd. (“Animax”), and its divisions, affiliates and subsidiaries, and others associated with any aspect of this contest, are not permitted to participate in the contest.
4.
No purchase is necessary. Participants are responsible for all costs of contest entries, including taxes.
5.
Animax and its agents, affiliates and/or representatives are not responsible for any loss of contest entries due to any problems caused by telephone lines or systems or internet service providers, or for contest entries submitted which are received after the deadline as a consequence of telephone or internet service delays, interruptions, failures or overloads, or for lost, stolen, misdirected, or misplaced contest entries. Contest entries are void if unreadable, inaccurate, incomplete, damaged, mutilated, tampered with, falsified, mechanically reproduced, irregular in any way or otherwise not in compliance with these Official Contest Rules.
6.
By sending a Submission and therefore participating in the contest, each participant agrees to follow these Official Contest Rules and be bound by any decisions made by Animax, including any interpretations of these Official Contest Rules.
7.
By sending a Submission, each participant agrees to the following eligibility requirements:
No Submission shall contain the names, titles, stage names, likenesses, pictures, images, sounds, voices, or work product (e.g., copy, photography, audiovisual materials) of any persons other than the participant and/or persons to whom the participant has explained the terms and conditions set forth in these Official Contest Rules (including, without limitation, Paragraph 9 below) and who, after hearing that explanation, have agreed to appear in and/or contribute to, the Submission subject to the Official Contest Rules’ terms and conditions;
No Submission shall directly or indirectly appear to or actually promote or advertise any person, entity, product or service other than the participant, Animax or any of Animax’s affiliates;
No participant shall make any trademark use or any other unauthorized use of any third party’s name, logo, trademark or service mark in any Submission or infringe the intellectual property rights, privacy rights, publicity rights, or any other legal or moral rights of any third party in any Submission;
No Submission shall contain any unlawful, defamatory, libelous, slanderous, obscene, sexually explicit, pornographic, violent, cruel, threatening, abusive, harassing, bullying, stalking, hateful, vulgar, racially or ethnically-motivated, invasive of another’s privacy, of poor quality, or otherwise objectionable, unfit for publication, posting, or otherwise dissemination for public viewing element, all of the above as determined by Animax in its sole discretion;
No Submission shall make any visual or audio references implicitly or explicitly to alcoholic beverages, tobacco, drug paraphernalia, firearms, or any depiction or representation thereof, or be perceived as giving or threatening to give rise to criminal or civil liability, encouraging conduct that might constitute a criminal offense, or encouraging or providing instructional information about illegal activities;
All rights in and to the Submission (excluding references to Animax or any of its affiliates) shall be fully owned or otherwise controlled by the participant; and
The Submission shall not contain music of any kind, and in the event that any music is inadvertently captured in any Submission, the participant agrees that any such inadvertently captured music may be erased by Animax from any such Submission in order to make such Submission eligible for consideration hereunder.
8.
By participating in the contest, except where prohibited by applicable mandatory law, each participant hereby grants and agrees to grant to Animax, its affiliates, successors, licensees, assignees and Animax’s authorized designees, a perpetual, fully-paid, royalty-free, transferable, fully sublicenseable, worldwide, irrevocable, non-exclusive right and license to use, adapt, translate, reproduce, edit, modify, create derivative works from, combine with other works, post, transmit, perform, display, publish, communicate, communicate to the public, broadcast, reformat, make available, disseminate, distribute, and/or otherwise aurally and/or visually exploit (any one or more of the foregoing referred to as “Use”) the Submission, and the participant’s name, likeness, image, photograph, voice, performance, rendering, signature, silhouette, sounds and/or biographical data contained therein and/or in the registration information accompanying the participant’s contest entry, in any media, manner, technology or content delivery mechanism now known or hereinafter devised, for any purpose, including, without limitation, in connection with the contest, its administration, judging, advertising and/or publicity, and in connection with the promotion, advertising, publicity and/or other exploitation of Animax, without the necessity of further consent or additional consideration.
9.
By participating in the contest, each participant agrees to sign any further documentation requested by Animax consistent with these Official Contest Rules.
10.
Each prize winner will be informed by telephone, email or regular mail. Each prize winner must confirm acceptance of their prize immediately with Animax. If Animax does not receive an answer from a prize winner within three (3) working days after an initial attempt to contact the prize winner is made by Animax, except when such period is extended pursuant to local law or Animax’s sole discretion, such prize winner will be disqualified. If a Prize winner is disqualified for this or any other reason, such as being found ineligible or failing to comply with these Official Contest Rules, then the first alternate will receive such prize instead, as will each of the subsequent alternates until all prizes have been distributed. Animax and its agents, affiliates and/or representatives will use their best efforts to contact prize winners but will not be responsible or liable in any way whatsoever if prize winners cannot be reached by telephone, email or regular mail within the three (3) day period. Winners do not become official until all contest entries are validated. All decisions of Animax are final and irrevocable.
11.
Animax and contest sponsors are responsible for all prizes listed above. No other parties, including without limitation, Sony Corporation of Japan, Sony Corporation of America, Sony Pictures Entertainment Inc., CPT Holdings, Inc. and their respective subsidiaries, affiliates, employees, agencies and branches, shall be responsible for any prizes.
12.
Except for the prizes themselves, all other costs, including additional software, options or upgrades, incidental costs and taxes, are the responsibility of each prize winner. Animax and contest sponsors do not cover any other costs.
13.
Prizes cannot be transferred, negotiated, refunded or exchanged, and by no means will a cash equivalent be given. Only a prize winner and not any other person or agent, may claim a prize. Prize winner will need to present proof of identification to collect prize.
14.
Animax has the right to substitute designated prizes with other prizes of similar or equal value in case it is necessary. Prizes may vary according to availability.
15.
All prizes will be awarded pursuant to these Official Contest Rules. All taxes in connection with prizes are the sole responsibility of each prize winner, unless provided otherwise in accordance with applicable law and regulations.
16.
Each participant shall fully indemnify and hold harmless each of Animax and its divisions, affiliates, subsidiaries, directors, officers, employees and agents, including without limitation, Sony Corporation, Sony Corporation of America, Sony Pictures Entertainment Inc., CPT Holdings, Inc. and their respective subsidiaries, affiliates, employees, agencies and branches, as well as all contest sponsors and all other associated with the development and execution of this contents (collectively, the “Indemnified Parties”) from any and all claims, damages, losses, demands, causes of action, proceedings, expenses, and/or liabilities resulting or arising from or connected with, or claimed to have arisen, resulted from or be connected with: (i) the participant’s Submission, participation, attempt to participate, or inability to participate, in the contest; (ii) submission and/or Use by the Indemnified Parties of any Submission (and/or any parts thereof); (iii) the participant’s failure to comply with any one or more of the Official Contest Rules or any applicable laws, rules or regulations; (iv) the unauthorized use by the participant of, as applicable, the name, likeness, voice, work product, brand, trademark, logo of any person or entity; (v) the breach or alleged breach of any warranty, representation (including, without limitation any eligibility-related representation) or covenant made by the participant in connection with the contest; (vi) acceptance and/or use of any prize; (vii) any right or benefit granted by the participant to Animax in connection with the contest; and/or (viii) the participant’s negligence, wilful misconduct, violation of any applicable laws, rules or regulations or these Official Contest Rules, or his or her violation of any third party’s intellectual property, privacy, publicity or other right.
17.
The chance to win is proportional to the number of total entries received.
18.
The contest is void where prohibited by law. All relevant national and local laws apply.
